1. Acceptance of These Terms
These Terms of Service govern your use of insidefortaleza.com and any services booked or purchased through the website (together, “the Platform”). The Platform is operated by Northclearview LLC, a Wyoming, USA registered company, trading as Inside Fortaleza (“Inside Fortaleza,” “we,” “us”).
By using the Platform, booking a consultation, or purchasing a service, you agree to these Terms. If you do not agree, please do not use the Platform.
2. What Inside Fortaleza Is
Inside Fortaleza is a content brand and technology platform that helps foreigners explore, understand, and plan a relocation to Brazil. We provide educational content, relocation guidance, and a platform through which you can book consultations and visa application services delivered by our legal processing partner.
Inside Fortaleza is not a law firm. We do not practise law, provide legal advice, or represent you in any legal or immigration matter. All legal services booked through the Platform are provided directly by J. Magalhaes, Brandao & Cruz Advogados (MBC), a licensed Brazilian law firm, or by another OAB registered legal processing partner named at the time of booking.
Where you purchase a legal service, you enter into two separate agreements: a platform services agreement with Inside Fortaleza, and a legal services agreement directly with the lawyer or firm handling your case. The legal services agreement governs the legal work itself.
3. Eligibility
You must be at least 18 years old to use the Platform or purchase any service. By using the Platform, you confirm that the information you provide is accurate and that you have the right to provide it, including on behalf of any family member included in a joint application.
4. Services Offered
Services available through the Platform may include, depending on what is live at the time:
- paid consultations with a licensed immigration lawyer
- visa application processing (Tourist, Student, Digital Nomad, Family Reunification, Golden Visa, Business Investment, renewals and extensions)
- CPF registration
- general relocation guidance and content
- referral to a property sourcing partner, Hub Property, for clients interested in purchasing property in Brazil
Not all services are available at all times, and availability may change without notice.
5. Consultations
Consultations are booked and paid for through the Platform. Following a consultation, you are entitled to one follow up email and one response from the lawyer. Further questions beyond that require a new consultation or, if you are proceeding, are addressed as part of your visa application once purchased.
If you proceed to a visa application within 30 days of your consultation, the consultation fee is deducted from the total visa fee. If you proceed after 30 days, the consultation fee is not deducted.
6. Visa Application Services
Once you purchase a visa application service, your case is passed to the legal processing partner, who will review your documents, advise on eligibility, and manage the application on your behalf. Response times, document requirements, and case handling are managed directly by the legal processing partner, though Inside Fortaleza remains available to assist with coordination.
You agree to provide accurate, complete, and timely information and documents. Delays in providing requested documents may delay your case.
No guarantee of outcome. Inside Fortaleza and its legal processing partners cannot guarantee that any visa, CPF registration, or immigration application will be approved. Approval is determined solely by the relevant Brazilian government authority. Our role, and that of our legal partners, is to assess your situation, advise you honestly on your prospects, and prepare and submit your application to the required professional standard.
7. Money Back Guarantee
Standard visa types (Tourist, Student, Digital Nomad, Family Reunification, CPF, renewals and extensions) are covered by our money back guarantee. If, after reviewing your submitted documents, the legal processing partner determines your application cannot proceed before submission, you are entitled to a full refund.
Golden Visa and Business Investment visa are not covered by the money back guarantee. These are bespoke, high value cases. Viability is assessed with you during your consultation, before any quote or payment is taken. Once you pay to proceed with a Golden Visa or Business Investment visa application, that payment is non refundable, regardless of the outcome of the application.
Full refund terms, including how refunds are handled if an application is submitted and subsequently refused, are set out on the relevant service page and in your services agreement at the time of purchase.
8. Fees, Payment, and Instalments
All fees are listed in USD and are payable through the Platform via our payment processor, Stripe. We do not store your full payment card details.
Some services may be available on an instalment payment plan. Instalment terms, including the schedule and what happens if a payment is missed, are set out at the time of purchase.
Government application fees, federal police fees, document apostille fees, health insurance, and translation costs are not included in our service fees unless explicitly stated. These are communicated to you before you proceed.
9. Third Party Services
The Platform uses third party tools and partners to operate, including Stripe for payments, Calendly for booking, MBC for legal services, and Hub Property for property referrals. Your use of these third party services may be subject to their own terms and privacy practices. We are not responsible for the acts or omissions of independent third parties, including our legal processing partners acting in their independent professional capacity, except as set out in our own agreements with you.
10. Property Referrals
If you submit a property enquiry, your details are shared with our referral partner, Hub Property, so they can assist you directly. Inside Fortaleza does not act as a realtor, does not conduct property viewings, and is not a party to any property transaction you enter into. Any agreement for property sourcing or purchase is between you and Hub Property or the relevant realtor.
11. Intellectual Property
All content on the Platform, including text, video, branding, logos, and the Inside Fortaleza name, is owned by Northclearview LLC or used under licence. You may not copy, reproduce, or redistribute this content without our prior written consent.
12. Acceptable Use
You agree not to use the Platform to:
- provide false or misleading information
- attempt to bypass or interfere with the Platform’s normal operation
- use the Platform for any unlawful purpose
We reserve the right to suspend or refuse service to anyone who breaches these Terms.
13. Disclaimers
The Platform and its content are provided for general informational purposes. Content published by Inside Fortaleza, including videos, guides, and social media posts, is educational in nature and does not constitute legal advice. Legal advice is only provided directly by the licensed lawyer handling your case, within the scope of your consultation or legal services agreement.
We make reasonable efforts to keep information on the Platform accurate and up to date, but immigration rules and requirements can change, and we do not guarantee that all content reflects the most current regulations at all times.
14. Limitation of Liability
To the extent permitted by law, Inside Fortaleza’s total liability to you arising from your use of the Platform or any service purchased through it is limited to the amount you paid for the specific service giving rise to the claim.
Inside Fortaleza is not liable for any legal error, omission, or professional failure on the part of an independent legal processing partner, or for any act or omission of Hub Property or any other independent third party referred through the Platform. Liability for legal services rests with the licensed lawyer or firm providing those services under your legal services agreement.
Neither party is liable for indirect, consequential, or punitive damages arising from use of the Platform.
15. Termination
We may suspend or terminate your access to the Platform if you breach these Terms. You may stop using the Platform at any time. Termination does not affect any obligations already accrued, including fees owed for services delivered.
16. Changes to These Terms
We may update these Terms from time to time. The date at the top of this page shows when it was last revised. Continued use of the Platform after changes take effect means you accept the updated Terms.
17. Governing Law and Disputes
These Terms are governed by the laws of Brazil. Any dispute arising from these Terms or your use of the Platform will first be attempted to be resolved through direct discussion in good faith. If unresolved, the dispute will be brought exclusively before the courts of Fortaleza, Ceara, Brazil.
